These Terms of Service define the conditions under which Aetherio, a sole proprietorship specializing in creating premium websites and digital experiences, offers its services to professional or individual clients.

Aetherio offers the following services:

• Custom website design and development
• Software and web application development
• UI/UX design
• Integration of 3D and immersive experiences
• SEO optimization
• Maintenance services
• Digital strategy consulting

The details of the service are specified in the quote provided to the client.

All orders are subject to a quote specifying the services, estimated timeline, payment terms, and specific conditions. The order is validated after express acceptance of the quote by the client (signature, mention of "Approved" or electronic validation) and payment of a deposit as specified in the quote.

Prices are expressed in euros and are net of taxes (VAT not applicable according to Article 293 B of the French General Tax Code). Payment is made according to the terms indicated in the quote. Any late payment may result in penalties in accordance with the law.

Timeframes are provided for information purposes only, unless expressly mentioned in the quote. Meeting deadlines depends on good communication and the timely transmission of materials by the client.

The client agrees to provide all information, content (text, images, logos...) and access necessary for the completion of the service. The client guarantees they hold the rights to the elements transmitted.

The source code, mockups, and creations made by Aetherio remain the exclusive property of Aetherio, unless otherwise stated in the quote or contract. Any transfer of rights must be subject to a written agreement and may result in additional charges. The transfer, if agreed upon, is limited to the intended use.

Unless otherwise stated, Aetherio may offer a hosting service via third-party solutions (e.g., Vercel). Aetherio acts as an intermediary and cannot be held responsible for interruptions or failures attributable to these external services. The client remains responsible for the renewal and ownership of their domain name, unless management is agreed upon with Aetherio.

Unless a specific maintenance contract is in place, any request for correction, update, or evolution after delivery will be subject to a new quote. Aetherio does not guarantee future compatibility of the site with external technical changes (browsers, hosts, plugins, etc.).

Aetherio undertakes to implement all necessary means for the proper execution of the service. Aetherio cannot be held liable for indirect damages, loss of revenue, or data. In any case, Aetherio's liability is limited to the amount of the service concerned.

In case of serious breach by either party, the contract may be terminated by right after formal notice has remained without effect for 15 days. In case of early termination by the client, amounts due for work already completed will remain with Aetherio.

Aetherio complies with GDPR rules. Data collected as part of the business relationship is used exclusively for project monitoring, billing, and communication with the client. The client has the right to access, rectify, and delete their data.

These Terms of Service are subject to French law. In case of dispute, the parties will seek an amicable solution. Failing that, the dispute will be under the jurisdiction of the courts where Aetherio is headquartered.
